YEE TWI KƆ - Terms and Conditions

The Vodafone “Yee Twi Kɔ” promotion starts on 15th September, 2016 at 00:00:01 GMT and ends on 15th Dec    December, 2016 at 23:59:59 GMT. The promotion is organized by Ghana Telecommunications Company Limited (operating under the brand name Vodafone Ghana, and hereinafter referred to as “Vodafone”).

 

1. Acceptance of Terms of Use

The following provisions define the terms and conditions (‘Terms and Conditions’) governing the promotion. By accessing and using the mechanics and prizes provided in this promotion, the Customer shall be deemed to have consented and agreed to these Terms and Conditions and be bound accordingly. 

All Customers warrant that they have read carefully and have understood fully these Terms and Conditions

 

2. Promo Features

 

2.1. There are two stages of the promotion.

·      Stage 1: Purchase, Scratch, Recharge and Win

·      Stage 2: Recharge, Use and Send Mobile Money for Points

 

2.2.  Promo duration: 90 days.

 

2.3.  Tariff: No special tariff applies.

 

2.4.  Subscription: No subscription fee applies.

 

3. Eligibility for Participation in “Ye Twi Kɔ

The following persons are eligible to participate:

 

3.1. Stage 1: Purchase, Scratch, Recharge & Win:

3.1.1.  All Vodafone mobile Customers who buy and recharge with scratch cards are eligible to enter or participate at this stage of the promotion.

3.1.2.  Vodafone Fixed Customers are also eligible to participate in the Purchase, Scratch, and Recharge & Win stage of the promotion. It is the sole responsibility of Vodafone Fixed Customers who win, to provide Vodafone Mobile numbers at a Vodafone Customer Service Point to which electronic money payments may be sent.

3.1.3. Vodafone reserves the right to disqualify any Customer if it has reasonable grounds to believe that the Customer has breached any provision of the Terms and Conditions.

 

3.2. Stage 2: Recharge, Spend and Send Mobile Money for Points:

3.2.1.  Only Vodafone Mobile Prepaid Customers would be eligible for this stage of the promotion.

3.2.2.  Vodafone employees and their immediate families (including spouses, parents, children and siblings) are NOT eligible to claim prizes in this stage of the promotion.

3.2.3.  All individuals professionally connected with Vodafone (including contractors, and owners and employees of registered vendors of Vodafone) are not eligible to participate in this promotion.

3.2.4.  All Customers must be 18 years or above to claim prizes at this stage of the promotion.

3.2.5.  Vodafone reserves the right to disqualify any Customer if it has reasonable grounds to believe that the Customer has breached any provision of these Terms and Conditions.

 

4. How to Participate and Win

 

4.1. Purchase, Scratch, Recharge & Win:

4.1.1.    To participate in the promotion, the Customer must first purchase a Vodafone Scratch card. Vodafone Scratch cards that are eligible for this stage of the promotion, are GHS2 and above in card denominations. The qualifying cards come with 2 scratch panels underneath the silver covering.

4.1.2.    Scratch Panel 1 to reveal the recharge pin for the standard airtime that the owner of the card has paid for. Panel 2 reveals a potential promotion prize for the holder.

4.1.3.    Scratch Panel 2 to reveal one of three options:

4.1.3.1. An airtime prize, in the form of a 14-digit recharge PIN, together with the value of the airtime. Customer can dial *134*XXXXXXXXXXXXXX# to recharge this PIN. Customer can also call 134 and follow the prompt to load the winning PIN.

4.1.3.2. A cash prize, payable in Vodafone Cash electronic money. The amount will be displayed on the panel. To redeem this electronic money, Customer will ensure that they have recharged the 14-digit PIN in Panel 1, onto the Vodafone mobile number to which they wish to receive payments. Within 36 hours of loading the recharge PIN on Panel 1, the winning Customer will receive an electronic payment to the tune of the amount displayed under Panel 2 of the scratch card.

a.      Cash winners who are registered for Vodafone Cash, may use electronic money for airtime purchases, withdraw physical cash (at a Vodafone Retail Store or Vodafone Cash agent), transfer to another Vodafone Customer or use it directly to pay for goods and services that accept Vodafone Cash payments.

b.      Cash winners who are not registered on Vodafone Cash, can still receive their cash prizes in the form of electronic vouchers. Customers with such electronic vouchers must either register for it to be converted to electronic money, or withdraw it into physical cash, within 30 days of receiving payments from Vodafone. All electronic vouchers expire after 30 days, if not redeemed by the winner.

c.      Cash winners who are not registered for Vodafone Cash, may register at a Vodafone Retail Store or Vodafone Cash Agent prior to withdrawing their winnings. Other transactions including airtime purchases, transfers and payment for goods and services shall not be possible without Vodafone Cash registration. A valid ID card is required to complete a Vodafone Cash registration.

4.1.3.5. A no win, “LOAD FOR POINTS” message will be seen.

 

4.2.    Recharge, Spend and Send Mobile Money for Points:

4.2.1   A Customer who tops up with a qualifying Vodafone recharge card, electronic top-up or Vodafone Cash airtime recharge, shall be awarded points. The standard for points awarded is 1 point for each GHS 0.10 recharged. However, Customers who recharge through Vodafone cash get double the points.

4.2.1.1.   Peer-to-peer transfer values (airtime and Vodafone Cash transfers), i.e. values that a non-retailer Customer transfers to another Customer, are not eligible to be awarded points under this stage of the promotion.

4.2.1.2.   However, commissions charged on such peer-to-peer transfers are eligible to be awarded points under this stage of the promotion.

4.2.2.  Customers will also be awarded points for purchasing Vodafone mobile products and services with their primary balance. These include bundle purchases, bundle renewals, out-of-bundle calls, out-of-bundle SMS, CRBT song downloads, CRBT subscriptions, SMS content, voice content, mobile internet pay-as-you-go, Instavoice services and any other primary balance depletion activity. The standard for points awarded is 1 point for each GHS0.10 spent.

4.2.2.1.   Customers will not be awarded points for any bonus account or secondary account activity which leads to the depletion of bundles or bonuses, but does not lead to a change in their primary balance.

4.2.3.  Eligible Customers may dial *5000# and follow the prompt, if they no longer want to accumulate points and therefore desire to leave the promotion. Upon dialling *5000#, a Customer can check their points build up, check their status and learn about the promotion.

4.2.3.1.   Customers who opt out of accumulating points will automatically lose all points. Where an opted out Customer intends to return to point accumulation, the Customer must dial *5000# and follow the prompt. The Customer will start accumulating points from a zero point balance.

4.2.3.1.   Point updates on *5000# may take up to 24 hours to reflect. Thus, Customers may not see their most recent transactions added to their cumulative points, if they check immediately after the transactions are completed.

 

5. Prizes

 

5.1.         Purchase, Scratch, Recharge & Win:

Over the promotion period, 726,100 individual prizes will be available on Vodafone scratch cards, GHS2 and above in denomination.

5.1.1. All prizes displayed on winning scratch cards must be activated before 31st March 2017 at 23:59:59 GMT.

5.1.1.1. For airtime prizes, activation means a winner having loaded the 14-digit airtime PIN on Panel 2 to claim the airtime value displayed on Panel 2.

5.1.1.2. For cash prizes, activation means a winner having loaded the 14-digit airtime PIN on Panel 1 to trigger the cash transfer process by Vodafone, of the value displayed on Panel 2.

5.1.1.3 The grand prize shall be presented to the winner with the highest points as at December 15, 2016.

5.1.1.4 The points accumulated by Customers through the purchase of airtime, usage or transaction on Vodafone cash after December 15, 2016 shall not count towards winning the grand prize. The points however can be used to redeem airtime.

 

5.2.    Recharge, Spend and Send Mobile Money for Points:

5.2.1. Weekly Prizes: For the purpose of weekly prizes, all participating Customers will be put into one of seventy seven (77) groups. Customers will only be competing against others in their assigned groups for the weekly prizes. On a weekly basis, Vodafone will award Customers with highest points accumulated in the respective seventy seven groupings, with the corresponding cash winnings (payable through Vodafone Cash electronic payments).

5.2.1.1. Weekly cash prizes shall be transferred to winners through Vodafone Cash electronic money payments.

5.2.1.2. The same Customer phone number cannot win more than two weekly prizes in any given calendar month   When potential winners reach this limit, the prize(s) will automatically pass on to the next highest point holder within the grouping. However, the winner of a weekly prize will still be eligible for a monthly prize.

 

5.2.2. Monthly Prizes: At the end of first month, second month and the last month of the promotion, monthly winners will be awarded cash prizes for accumulating the highest number of points nationwide within the target month. The following monthly prizes shall be given each month of the promotion, payable through cheque or bank transfer.

5.2.2.1. A Customer shall be eligible to win only one monthly prize, during the entire duration of the promotion. However, such Customer will still be eligible for the ultimate prize.

 

5.2.3. Ultimate Prize: At the end of the entire duration of the promotion, the single Customer with the highest cumulative points over the entire period will be awarded a GHS150, 000 cash prize payable through cheque or bank transfer. Five (5) other Customers will win GHS 10,000 each payable through cheque or bank transfer.

5.2.3.1. In the final month of the promotion, should the winner of the ultimate prize also be eligible for a monthly prize, Vodafone shall award the Customer with ONLY the ultimate prize. The forfeited monthly prize will pass on to the Customer with the next most eligible number of points and who has not already won a monthly prize.

5.3.         In the event of a tie during the winner selection process, the Customer that reaches the point figure in contention first, within the eligible time, will be deemed to be the winner.

5.4          The current statutory withholding tax law applies to all winnings

 

6. General Terms for Prizes:

6.1.         Winners of cash prizes will be notified by Vodafone once their prizes are activated. The winners shall sign all consent documents and provide identity documents required by Vodafone before prizes are actually handed over.

6.2.         Vodafone shall not be responsible for the process of Customers converting their electronic money into physical cash or exchanging it for goods and services.


7. Limitation of liability

7.1.         Vodafone accepts no responsibility whatsoever for and without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control.

7.2.         Vodafone reserves the right to suspend the campaign temporarily or permanently for legal, regulatory and for operational reasons (e.g. for repairs, planned maintenance or upgrades) whenever it is deemed necessary. Vodafone undertakes where possible to restore the campaign as soon as practicable after any temporary suspension period. Vodafone shall not be liable for any claims, losses or injuries whatsoever the Customer may suffer as a result any such suspension.

 

8.  Disclaimer of Warranties

8.1.         Vodafone makes no warranty, implied or express, that any part of the promotion will be uninterrupted and error-free.  

8.2.         Neither Vodafone nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any Customer for participating in the promotion or as a result of accepting any prize.  

8.3.         Vodafone shall not be responsible for any technical malfunction of any telephone or lines, computer on-line systems, servers, or providers, computer equipment, or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to Customers’ or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials on the promotion. 

8.4.         By entering the promotion, Customers agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted or made against Vodafone, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or user of any prize, including without limitation, personal injuries, death and property damage. 


9. Data protection and Publicity 

9.1.         By participating in the promotion, the winners agree that any of their data, including names, names, photos and video images, may be used by Vodafone for advertising, demonstration or marketing purposes with no prior consent of the winner and at no charge to Vodafone.

9.2.         Customers agree that if they win a prize their names and phone number will be published for informational purposes only.

9.3.         Vodafone as a Data Controller may disclose Customers’ data to its contractors or agents (data processors) in line with the Data Protection Act, 2010 (Act 843) to assist in conducting this promotion or any future promotions.

 

10. Miscellaneous 

10.1.       Vodafone reserves the right to terminate, suspend, cancel or amend the promotion and these Terms and Conditions at any time. Any changes will be posted online and shall be binding on a Customer.

10.2.        In the event of dispute regarding the interpretation of the Terms and Conditions, conduct, results, and all other matters relating to the promotion  the decision of Vodafone shall be final and without appeal.

10.3.       These Terms and Conditions will remain in full force and effect while the promotion lasts (not taking into account temporary suspensions of the offer for operational reasons, e.g. for repairs, planned maintenance or upgrades).

10.5        These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana.
