The Vodafone “Ekiki Mi” promotion (“the Promotion”) starts on 15th August, 2017 at 00:00:01 GMT and ends on 13th October, 2017 at 23:59:59 GMT (“the Promotion Period”). The Promotion is organized by Ghana Telecommunications Company Limited (operating under the brand name Vodafone Ghana, and hereinafter referred to as “Vodafone”).

 

1. Acceptance of Terms of Use

 

The following provisions define the terms and conditions (‘Terms and Conditions’) governing the Promotion. By accessing and using the mechanics and rewards provided in this Promotion, the Customer shall be deemed to have consented and agreed to these Terms and Conditions and be bound accordingly.

 

All Customers warrant that they have read carefully and have understood fully these Terms and Conditions.

 

2. Promo Features

 

2.1. Share the full value of your used scratch card with two (2) other consumer pre-paid Vodafone Customers (“Party B1, B2 or Parties B” as the case may be). This can be done in four (4) stages

Stage 1: Party A buys a Vodafone Scratch card of value GHcX

Stage 2: Party A scratches & loads airtime using *134*pin#

Stage 3: Party A gives same scratch card or pin to a maximum of two other people, Parties B

Stage 4: Parties B can load card using the code *135*pin# to receive full value each i.e. GHcX each

 

Promo duration: 60 days. 

 

Tariff: No special tariff applies.

 

Subscription: No subscription fee applies.

 

3. General Mechanics for Promotion



3.1.    Promotional Mechanics:

  • Party A purchases a scratch card of value GHCX

  • Party A reloads the pin and receives airtime in his primary balance, worth the value on the scratch card, GHCX

  • Party A shares the same scratched card with up to 2 Parties B, for them to load the same pin.

 

3.2     Promotional Benefits:

  • Party B1 reloads same card using *135*pin# and receives GHCX worth of credit for on-net calls and Data PAYG only.

  • Party B2 reloads same card using *135*pin# and receives GHCX worth of credit for on-net calls and Data PAYG only.

3.3    Promotional Rules:

The following rules will apply to the use of this multiple recharge card:

  • The bonus airtime to be enjoyed by the Parties B, can only be topped up using *135*pin#

  • The bonus airtime to be enjoyed by the Parties B, can only be used for on-net voice calls and data PAYG

  • Party B should top up within three (3) days of Party A topping up, failure to do so renders the card invalid.

  • Bonus airtime given to Parties B, will be charged at the Customer’s default rate or Out of Bundle rate i.e. per the Customer’s current offer (depleted at applicable per second rate) and data will be charged at regular data PAYG rate of 12.5 pesewas per megabyte.

  • Bonus will be utilised for charges before regular credit or primary bucket starts to run.

  • The bonus airtime to be enjoyed by the Parties B, will have two (2) days limited validity, inclusive of day of top up ending on midnight of day two (2).

  • Customers’ Bundle Buckets have priority over bonus airtime



4. Eligibility for Participation

 

The following persons are eligible to participate:

 

4.1. Party A: All Vodafone subscribers who are currently eligible to recharge with a scratch card. This covers Consumer Mobile Prepaid subscribers.

 

Parties B: Only Consumer Mobile Prepaid subscribers.

 

Scratch Cards: Only GHC 2, GHC 5, GHC 10, GHC 20 and GHC 50 scratch cards can be shared.

 

4.2. Vodafone reserves the right to disqualify any Customer if it has reasonable grounds to believe that the Customer has breached any provision of the Terms and Conditions.


5. Limitation of liability

5.1.    Vodafone accepts no responsibility whatsoever for and without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control.

5.2.     Vodafone reserves the right to suspend the campaign temporarily or permanently for legal, regulatory and for operational reasons (e.g. for repairs, planned maintenance or upgrades) whenever it is deemed necessary. Vodafone undertakes where possible to restore the campaign as soon as practicable after any temporary suspension during the Promotion Period. Vodafone shall not be liable for any claims, losses or injuries whatsoever the Customer may suffer as a result of any such suspension.

 

6.  Disclaimer of Warranties

6.1.     Vodafone makes no warranty, implied or express, that any part of the Promotion will be uninterrupted and error-free.  

6.2.     Neither Vodafone nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any Customer for participating in the Promotion.

6.3.    Vodafone shall not be responsible for any technical malfunction of any telephone or lines, computer on-line systems, servers, or providers, computer equipment, or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to Customers’ or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials on the Promotion. 

6.4.     By entering the promotion, Customers agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted or made against Vodafone, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance, including without limitation, personal injuries, death and property damage. 

 


7. Data protection and Publicity 

7.1.    By participating in the promotion, the winners agree that any of their data, including names, photos and video images, may be used by Vodafone for advertising, demonstration or marketing purposes with no prior consent of the winner and at no charge to Vodafone.

7.2.     Vodafone as a Data Controller may disclose Customers’ data to its contractors or agents (data processors) in line with the Data Protection Act, 2010 (Act 843) to assist in conducting this promotion or any future promotions.

 

8. Miscellaneous 

8.1.     Vodafone reserves the right to terminate, suspend, cancel or amend the promotion and these Terms and Conditions at any time. Any changes will be posted online at  http://www.vodafone.com.gh and shall be binding on the Customer.

8.2.     In the event of dispute regarding the interpretation of the Terms and Conditions, conduct, results, and all other matters relating to the Promotion, the decision of Vodafone shall be final and without appeal.

8.3.     These Terms and Conditions will remain in full force and effect while the Promotion lasts (not taking into account temporary suspensions of the offer for operational reasons, e.g. for repairs, planned maintenance or upgrades).

8.4    These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana.

8.5    All other Vodafone Terms and Conditions regarding the use of the Vodafone Services remain applicable.
