Vodafone Black (also referred to in this document as the “Service”) is an exclusive, members only service of Ghana Telecommunications Company Limited (trading as Vodafone Ghana, and hereinafter referred to as “Vodafone”)
All Vodafone Black members warrant that they have carefully read and fully understood the contents of these Terms and Conditions
These Terms and Conditions are subject to Vodafone Ghana’s general Terms and Conditions and policies
To enjoy this Service a customer must be a subscriber of Vodafone with a validly registered Vodafone SIM card or having ported their existing mobile number to the Vodafone network (the porting process must have been completed before the commencement date of this Service)
By agreeing to become a member of the Vodafone Black Service the customer agrees to be bound by these Terms and Conditions
Who is eligible?
Vodafone Black is free and is available to Prepaid and Post-paid customers on Vodafone’s network who are invited into the Service based on the criteria set by Vodafone.
What is Vodafone Black?
Vodafone Black is an invitation only service which offers members an unlimited personal experience that cuts across products and customer experiences.
The benefits of Vodafone Black include but are not limited to handsets and device contracts, call plans, mobile and fixed broadband bundles.
Members of Vodafone Black get special offers to purchase high-end devices and with premium unlimited call plans under a consumer finance programme with a participating partner institution. (details of the consumer finance programme are outlined below).
Vodafone Black status will entitle the member to special services at selected institutions and hospitality service providers.
To claim special services and benefits provided under Vodafone Black, members must identify themselves by presenting a valid membership card or dialling *5152#.
Consumer Finance Plan
To participate in this offer the invitee must apply to purchase the particular device from a participating partner’s consumer finance sales channel.
The participating partner will assess the application and communicate its decision to approve or reject the application to the customer.
Vodafone will make the selected Products and services available to the Applicant within a minimum of three (3) working days of receiving notice from the participating partner that the Applicant’s application has been approved.
Call Plans under Vodafone Black membership shall be subject to Vodafone’s terms and conditions.
Participating partners’ Terms and Conditions may apply when purchasing a product under the Consumer Finance Scheme.
Under the Consumer Finance Plan, Vodafone Black members are entitled to high end devices and call bundles and plans.
Device warranties and Repairs
Vodafone Black members shall be further entitled to special aftersales service and warranty up to the following durations;
Twelve (12) months warranty on all handsets and tablets;
Six (6) months warranty on other devices such as Dongles, Mobile Desk phones and Mifi and;
A valid proof of purchase must be provided when this service is claimed.
During the warranty period, all defective terminals will be repaired, unless the nature of the defect requires otherwise. However, the accessories (battery, charger and hands free) may be replaced.
The warranty does not cover the following
normal wear and tear, corrosion, oxidation, rust, deterioration, and natural damage.
damage to the exterior, such as damage to the surface paint, scratches, and discoloration.
faults caused by unauthorized disassembly, maintenance, or modifications (including modifications to hardware and system software).
damage or functional issues caused by failure to observe the instruction manual.
faults or damage caused by force majeure (such as earthquakes, fires, lightning strikes, and unstable power supplies).
loss or damage to data, software or applications that are not required for the phone’s basic features.
Devices that were repaired outside of warranty.
All devices submitted for repair shall be repaired within Five (5) days after receipt of the device unless the nature and context of the required repairs necessitates an extension of the aforementioned 5 days.
Termination of membership
Either Vodafone or a member of the Service may terminate this contractual relationship at any time.
Continuing membership of the Service requires the member to maintain a minimum spend criteria set by Vodafone. Customers who do not maintain this minimum spend will lose their membership status and its attendant.
If a member wishes to voluntarily cancel the contract, the member must notify Vodafone in writing through his Relationship Manager or the dedicated mailbox – .
A member who opts out of Vodafone Black membership will forgo all accrued benefits. Accordingly, the membership card issued by Vodafone under the Service to such member will no longer be valid regardless of its expiry date and should be returned to Vodafone immediately.
A customer’s membership may be terminated if a that customer makes material misrepresentations contrary to or in violation of the rules contained in these Terms and Conditions. All benefits shall expire as soon as Vodafone issues the notice of cancellation.
Limitation of liability
Vodafone accepts no responsibility whatsoever for and without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control.
Vodafone shall make commercially reasonable efforts to ensure that the benefits promoted as being available to members will actually be available as represented. However, Vodafone does not guarantee or warrant that such benefits shall always be available. Vodafone advises members to check availability of the desired benefits on its website or with an assigned Relationship Manager prior to redemption of the said benefits.
If for any reason any aspect of this Service is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of Vodafone which corrupts or affects the administration, security, fairness, integrity or proper conduct of this offer, Vodafone may in its sole discretion modify or suspend this Service or invalidate any affected membership. If an act, omission, event or circumstance occurs which is beyond the reasonable control of Vodafone and which prevents Vodafone from complying with these Terms and Conditions, Vodafone will not be liable for any failure to perform or delay in performing its obligation.
Vodafone reserves the right to suspend the Service temporarily or permanently for legal, regulatory and for operational reasons (e.g. for repairs, planned maintenance or upgrades) whenever it is deemed necessary. Vodafone undertakes where possible to restore the Service as soon as practicable after any temporary suspension period. Vodafone shall not be liable for any claims, losses or injuries whatsoever the Customer may suffer as a result any such suspension
Disclaimer of Warranties
Vodafone makes no warranty, implied or express, that any part of the Service will be uninterrupted and error-free.
Neither Vodafone nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any Customer for participating in the Service.
A member’s continued participation in Vodafone Black constitutes the member’s acceptance of any changes to these Terms and Conditions. Members are responsible for remaining knowledgeable as to any changes that Vodafone may make to these Terms and Conditions. Vodafone will endeavour to make available the Terms and Conditions and any changes thereto on the Vodafone website – www.vodafone.com.gh
If Vodafone or any Partner improperly denies a member any benefits that the member ought to have earned under the programme, the member’s exclusive remedy shall be the issuance of the improperly denied benefits by Vodafone, if available, or such other reasonable, alternative and comparable benefits as determined by Vodafone. In the event of any of the aforementioned improper denials, the liability of any Partner shall be limited to the value of the benefits concerned.
Members are liable for any claims from third parties, including the tax authorities, arising from membership in this Service.
Personal data relating to members in the program will be processed and used for purposes of Vodafone Black in accordance with applicable Data Protection Law. Personal data shall be used and exchanged by Vodafone and the Partners as required by the program. Also, information concerning members and their participation in the program may be transmitted confidentially between Vodafone and the Partners for their sole usage. If a member does not want to receive offers from Vodafone and/or the Partners, the member may object, to the processing of the member’s data for this purpose by notifying Vodafone via the exclusive mail box – or through their dedicated relationship manager at any time in writing.
Vodafone reserves the right to terminate, suspend, cancel or amend the offer and these Terms and Conditions, reward structure, discount structure, participation of any Partner in the Service, or procedures at any time. Any changes will be posted on the Vodafone website and other online platforms and shall be binding on a Customer. Vodafone will use all endeavours to minimise any effect on the consumer in order to avoid disappointment.
In the event of dispute regarding the interpretation of the Terms and Conditions, conduct and all other matters relating to the offer the decision of Vodafone shall be final and without appeal.
These Terms and Conditions will remain in full force and effect while the offer lasts (not taking into account temporary suspensions of the offer for operational reasons, e.g. for repairs, planned maintenance or upgrades).
These Terms and Conditions shall be governed by and construed exclusively in accordance with the laws of the Republic of Ghana
